the commute. traffic is good. misty weather though and that could make for wet roads. how about the desk. we're starting with breaking news, sad story a baby is among two people killed in a shooting that happened in oakland. and talking to neighbors with more information. someone crept into the backyard off gormley avenue. a man was inside. he may have been targeted. if you look here there is a house we're talking about a baby was killed. police have roped off the street here, this is where the shooting happened. the parents of the 20 year old, they are distraught. it may have been their grandson. shots range out before 3:00. and someone fired their gun

into a back bedroom and striking the victims. and the baby was transported and the man died on the scene. >> (speaking spanish). >> a neighbor heard 8 to 6 shots. he was sleeping and got up to go to work. they have seen children playing in the whether or not yard but they don't know who the residents are. to give you an idea where it happened, we're east of 880 by the airport and police have been going door to door asking neighbors what they saw or heard. we don't know what the motive is or if there is a suspect description. they have been interviewing witnesses inside of the house trying to learn how all of this unfolded. today family members of a missing woman will pass out fly merse hopes of finding her.

590 year old was seen on sunday night when she left her home to meet someone who found her missing dog. her dog was stolen when her home was robbed. her sister said she is an investigator for the public defender in sacramento and a single moth weir a 15 year old daughter. >> this is not like my sister. we are worried. something is wrong. >> she said someone tried to extort money saying they had her dog when they did not. she says that her work phone and home cell phone had been found. one near emmyville the other near an exit ramp off 80. and her car was found two miles from her home. and 5:03. right now in ohio. we'll show you live pictures. crews are in the process now of tearing down, look as they focus in on that, and cleveland

present their cases to a special board of inquiry in a public hearing. the hearing will take place at the state building in oakland. both sides will summarize the issues that are in dispute and discuss how a bart strike would affect the public. the board will report the findings by the end of the week and the governor could call for a 60-day cooling off period to keep the trains rolling. the hearing starts at 10:30. it is open to the public. it will be held in the state of california building at 1515 clay street we will stream that live. residents on the south bay, if you complained about a smell in your water you have nothing to worry about that's according to the water service company. it is blaming the santa clara district which supplies the water. the odor is caused by compounds

bit better. five small grass fires being investigated. and she just got there. where are you and what do you know. >> i'm here along the lanes near the bailey exist and the firefighters are out here. i don't know if you can see them behind me. i want to show you the ground here it caught on fire we don't know how it started. that's why there are investigators to figure out how it started. and at 3:09 this morning several calls came in with people reporting along the freeway. 3 fires near the southbound lanes of 101 before the bailey exit were there and the other two small fires were near met calf road a half a mile north of bailey. all the fires are knocked down and 30 minutes with the help of

of any terrorism but the investigation continues. the president is waking up in southern california this morning. last night he was on the tonight show with jay leno not for laughs but he talked about the serious issues like the trayvon martin case. and we have more on some of the things the president said. >> dave, this is the president's sixth appearance on leno, fourth as president. they talked about a wide variety of topics and the high- profile case with george zimmerman and trayvon martin. he said he teenage boys don't have the best judgment they will mess up. it was particularly sensitive for african-american families especially for those who have teenaged sons. he said young black men have involvement in criminal activities and violence for numerous reasons from poverty to bad neighborhoods to failing

lines heading to the mission district. low clouds, cool midlevel clouds and shaded with this area of low pressure should be there another day and it is noticeably cooler. the big story will be the low overcast and making it pretty car inland even clouds wrapping around northern california. slow warming. 50s or 60s. temperatures are stuck. you can see the cloud cover in nevada and chico and extreme northern california. it bears watching for tomorrow.

the death of a firefighter in oregon. jessie trader was child a roll over crash rushing to get to a wildfire. he was driving a water tanker on a road when the truck flipped over and rolled into a ditch. firefighters driving behind him

stopped to help but it was too late to save him. >> we pass on our condolences to his friends and family. >> he joined the training program right out of high school. he was the second firefighter killed in oregon this fire season. this morning a massive manhunt is underway for a man accused of abducting two children who are the subject of an amber alert. james dimaggio burned down a home killing the children's mother and unidentified child. there was an issue alert for hanna and her brother eton. the family members say the child found in the house is eton anderson but they have not confirmed that. he may be driving a blue four- door nissan with plate number 6

wcu 986. >> bring my cousin home. >> they held this vigil. her father and grandmother. and they were asked to not give up hope. he was a friend of the family they say he rented a room from hanna's grandmother before buying the home he is accused of burning down. the amber alert took a lot of people by surprise. many didn't realize that cell phones are equipped with the alert, it is the first time it was sent out statewide. now you have to opt-out if you don't want the alerts but the chp hopes the technology will make a difference in the search for missing children. >> that's the first i was aware

traffic is looking good. if you heard of the delay the signal problems they have been fixed. it will take time for them to be back. the traffic looks good. now back to the desk. we have breaking news a baby among two people killed in an early morning shooting in oakland. and we have more live from the scene where grieving family members are gathering. they were calling out the name. and extremely grief stricken. an unfortunate situation here. you can see that it is roped off here. and someone crept into the backyard of the house with the light on. and now again police are interviewing people inside the house. neighbors say that 6 to eight shots range out before 3:00

this morning. police say that someone fired their gun into the back bedroom of the home. family members say it was a 20 year old father and son. the man died on the scene. detectives arrived a half hour ago and the bullet casings and looking through the evidence. where it happened, we're east of 880 by the airport. police have been going door to door asking neighbors what they saw or heard. or if there is a suspect description. but obviously this was not a random shooting. police believe person was targeted. the man accused of rifing his car into a crowd says it was a certainly accident.

and he was charged with three dozen felony counts and murt assault and hit and run. a car smashed into the crowd. 16 other people were hurt. and he is being held on one and a half million dollars bail. a man who stopped a gunman said he is no hero. and he wrestled suspect to the ground after he opened fire. three people were killed. they credit the man with preventing a bigger tragedy. he said he was trying to save his wife. 5:33 right now 5 small grass fires are being investigated. they started just hours ago near highway 101. and we are live in santa clara

and what are they telling you? >> well, right now they still -- it is dark out here they don't have any clue how these fires started. they were burning over 101. it is dark, it may be hard to see. there were three small fires burning here. let's go to video that was take non-the last hour. at 3:09 this morning. several calls came into 911 with people reporting grass fires along the freeway. now three of the fires were found on the southbound lanes before the exit and a half mile north of bailey. all those fires were put out. san jose were the first to

arrive and then cal fire showed up. there was confusion over the jurisdiction. and so now cal fire has taken over the investigation. they have been out here with their flashlights looking to see it is particular. it could be a cigarette or and pack up it and they will come out when it is daylight and how it started. and investigators now searching for a second man who may know something about sunday's deadly stabbing attack at a hardware store. they say he was just starting his shift at an ace store when someone walked in and stabbed

him 17 times. and a man from sacramento is charged with the murder. but they want to talk with a man who came in at the same time as agnew. video shows him arriving in a white car ahead of the man believed to be agnew. this stabbing was a random act of an unstable man. ac transit buss are running this morning after a deal was reached to avert a strike. and it has agreed to a 9.5% raise over three years for more than 1600 union employees. that deal will keep the riders from being stranted by a strike that was scheduled to start after midnight. they wish a deal had been reached sooner but the negotiations were not contentious. there was a lot of respect. it was a long process than we wanted it to be. but because the issues were

difficult. >> now the union members have to ratify that contract later this month. and ac serves 181,000 rider as day in the east bay and into san francisco. >> target is looking for 450 people to work at two of the stores in the bay area. it will be at the city target and the store and all interviews will be at the college of marin can you sign up for a confirmed interview time or walk in and wait for an interview slot. the hiring will start today it runs through saturday. both of the -- both stores open in october. tonight someone out there could be $425 million richer. that's when the numbers will be drawn for the powerball. and it could be close to a half a billion. the odds are one in 175 million. listen to this. i don't know who came up with this. you have a better chance of

u.s. ambassador. officials say that threfrl suspects, including a prominent leader in libya, have been charged in the attack. details of the charges are under seal and the investigation continues. time now is 5:45. the trial of the doctor accused of killing people at fort hood continues today. yesterday acting as lawyer in his opening statement, the major told the court the evidence will clearly show that he is the shooter. he is charged with killing 13 people and injuring 30 back in 2009. one of the shooting victims who survived said he has physical as well as emotional scars. >> i cannot go in crowded places. i do not go to the mall. ky not take my child to disney land. ky not deal with it. >> if convicted he could be the first american soldier to be sent to death row and executed

since 1961. san francisco will be the  late toast host a gun buy back event. it is scheduled for tomorrow night. now people who are bringing in unloaded guns will receive $100.200 for assault weapons. it is coming from donations and funds. the event starts and runs from 6 to 8 p.m. tomorrow night and held in the parking lot of the u.s. bank on 22 -pbt and cap streets. police throughout the area are calling the 30th national night out a success. >> it is a good time for limbo. last night about 50 people gathered for an event in san jose. it was an example of law enforcement cooperation. people there concerned about the vandalism in the area though and the lack of police officers on the streets. some have enrolled in a networking site called next

york. and as the plane was landing the copilot had been they controls with the captainch whatting the instruments. when it was 400 feet off the ground they switched their roles. investigators say changing roles is not unusual but they are investigateing why they changed and why they did it so close to the ground. an auditor from livermore is accused of abusing the son of a friend. tim rodriguez was arrested at his home on monday. he is suspected of molesting the nine year old boy. he is a registered sex offender and convicted in 1989 in connection with a case from fremont. he faces 25 years to life in prison. and people in palo alto are being told to lock their windows and deers. there have been six burglaries in the city in the past week and a half. the first one was on july 26th. the most recent was on august 1. and investigators say it apierce the cleeves entered the
